CIC in Shankar Lal Sharma Vs Passport Office held that

1. The appellant filed RTI application dated 11.12.2014 seeking information regarding the certified copy of passport of Sh. Suraj Prakash Sharma issued in the year 1983.

5. The respondent referred to the CPIO’s reply dated 09.01.2015 and stated that they have informed the appellant that the passport record prior to the year 1996 is not available in their office.

7. During the hearing, the respondent stated that even if they had the information, the same cannot be provided to the appellant as it is third party information which is exempted under Section 8(1)(j) of the RTI Act, 2005.

Decision:

9. The respondent is directed to provide the relevant extract of their record retention policy for maintenance/destruction of records to the appellant and a copy to the Commission, within 15 days from the date of this order. The respondent may also indicate that the relevant record has been destroyed in pursuance of their policy.
