What if a state does not follow the order of the Supreme Court?
If the State Government is willfully / willfully not following the Supreme Court and willfully not implementing such order, you can file a Contempt of Court petition in the Supreme Court against the concerned officials of the State Government. If the lapse is being done at the Ministry level, you can file a contempt petition against the Secretary in that Ministry/Department.
The government enforced the order, usually under threat of contempt action. Otherwise, the Court may proceed with contempt against the officials concerned [under the provisions of the Contempt of Courts Act, and also under Article 129 of the Constitution of India] who are responsible for willfully not implementing its order.
