14.1- I have filed an RTI date...       The  Public Information Officer [        hereinafter referred briefly as  PIO]  did not take any action on it.

15.   Within the     maximum time limit  of 30 days prescribed in Section 7[1]  of the RTI Act, the  PIO  neither responded to  the RTI  nor gave any fee information  nor  any   fee information. Information given.

16.The PIO      rejected  my RTI in  violation of Sections 2 and 7  in violation  of the  law.

17.     Regarding  information relating  to third parties, the  PIO did not follow the procedure laid down in Section 11  and arbitrarily    refused to disclose third party information.

18. Further,  in violation of sub-sections  3(b)  and  8  of  Section 7, the  PIO granted me the period of first appeal [time limit] and the  First Appellate Officer required it.  I didn't even give information  .  Not only  this, but the  PIO has also committed a serious statutory error by not complying with the order of  the AO  .

19. Thus, the    PIO has  clearly  violated the  provisions of section  2 and section 3 and  sub-sections  1,  3[a], 3 (b) and  8 of section 7.

20. This unlawful act   of the PIO  clearly falls  under the    penal purview under Sections  19(8)[b] and 20[1] and 20[  2].

21.  I  had filed the  first appeal against  the   undue  denial  of  information sought by the PIO. 

22.But the AO has violated   its quasi-judicial  obligation by  not taking any action within the 30-day  time limit stipulated in Section 19[6].  While appeal is the  invaluable right of the  aggrieved person, which has been given to  him to  rectify  the  error at  the lower level  .

23.   Even after  the AO  has given me a  reasonable opportunity  of hearing, i am  not getting   any information till date  .

24. Provide   information on your order date...  AO has   failed to comply  .

25.   Please convey my appeal   at the earliest   .

26.Provide    all   the  information I want as provided in section 7[6]  free of charge and as soon as possible.

28. For this  , the  PIO  should   be  summoned to the  hearing along with the  documents related to the desired information.

30. The PIO did  not  discharge his quasi-judicial  duty as stipulated in  the RTI Act in accordance with the  law. He has  set   a serious example of  dereliction of duty by violating various provisions  mentioned above in the  RTI Act.

31.Therefore, the   maximum penalty under  section 20[1]  should  be imposed against the guilty PIO  .

32.   Concealment  of   information under the  Right to  Information Act   falls under   the  category of misconduct   under the Service  Rules.   Therefore, departmental action   /disciplinary action against the PIO under section 20[2]  is to  be taken   .

37.Due to this   , I have suffered unnecessarily   physically  , mentally and financially.

38.  To   compensate me for   this loss caused to   me   due to a statutory error of the PIO, please     pay a  compensation of at least ₹5,000  under Section 19(8)[b].

40. The First Appellate Officer  has  not  discharged  his quasi-judicial  duty   in accordance with law  .

41.A  copy of this order of yours shall be sent  to the  senior officer/officer of the  Appellate Officer.  Please send it to the head  of the department as well.
