 The settlement deed in a partition suit must contain the written consent and signature of all the parties,

 In a suit for partition of joint property, the decree cannot be maintainable merely by consent between some of the parties.

 

 When an agreement deed has been executed in respect of a joint property, it is necessary to record the written consent and signatures of all the parties to such agreement to have validity.
