Subject: Notice - Illegal Detention Attempt by High Court of Kerala & Entry on 21.02.2023

Reference 1 - Your Letter No. R-4/2023/Enquiry dated 09-02-2023.

Reference 2 - Entry Pass Registration Slip No. RN8681/2023.

Mr. Krishnakumar,

Apart from the crimes of criminal intimidation, assault and theft committed on me, the respondent in Cont. Case(Crl) 4/2022, by officials under your command on 08 February 2023, you are attempting to detain me illegally from the entrance of the High Court complex to the court hall 3B on the third floor on my days of appearance in the court in Cont. Case (Crl.) 4/2022 as Party-In-Person.

You have indicated in your letter that you will continue to restrain me at the entrance of the high court by not permitting even a single person accompanying me to enter the high court complex along with me. In your letter you have also tried to make a whimsical interpretation of an interim order passed by the division bench on 08 February 2023 to say that entry pass will not be issued to any person accompanying me. There is no such statement in the said order and there is no such order from the division bench.

It is a matter of Right to Life and Liberty that as the respondent in the case, I be accompanied by family members, friends or co-workers. You are attempting psychological restraint on me as a tactic and in an attempt to weaken me in a case that you have initiated against me before the high court of Kerala. This is unconstitutional and can be only termed as a cowardly act. It is clear from your letter that you have initiated these steps specifically in this case, but there is nothing on record to substantiate your claim that the judges of the division bench instructed you to deny entry passes to persons accompanying me as you did on 25 January 2023 and 8 February 2023. Your reference to me, the respondent, in your letter as "Contemnor" also indicates your attempts and desire to sabotage the trial procedures underway in the high court of Kerala.

I am appearing before the division bench in Contempt Case (Crl.) 4/2022 in Court Hall 3B on 21 February 2023 at 10:15 AM. You are hereby given notice that Mr. Sajan Aziz whose identity details are submitted online under the header 'Persons Accompanying" in the online pass application portal of the High Court of Kerala, be allowed with me without any issues or commotion created by you and your officials at the entry to the high court complex. The registration slip number is referenced in this notice.

If you deny entry to the person accompanying me, that shall amount to an attempt to detain me illegally and off-record inside the court complex and I shall not cooperate with you. You may detain me on record and if you have a judicial order to do so, I shall cooperate.
