SUB ::  TARGET FOR REVENUE COLLECTION -   SUB REGISTRARS OFFICES

It has come to our notice that oral instructions have been issued to all Sub Registrars, District Registrars and Other senior Officers of Stamps and Registration Department to increase the revenue collection.   Even targets have been given to achieve them by the financial year end.  This is causing concern amongst Officers and Employees of the department.   Under the pressure from government illegal registration of documents by violating the government guidelines particularly registration of revenue sites have been considerably increased.   Sub Registrars can not campaign for property owners to sell their properties or buy new properties.  Transfer of Property is a requirement of individuals and can not be promoted under the guise of revenue collection. 

WE have few suggestions to the government to increase the revenue collection through legal methods:

1. Several Supreme Court and high court judgments have held that unregistered agreement of sale will not be recognised in a court of law. An important judgment on this issue was delivered by the Allahabad High Court in the Vijay Kumar Sharma vs Devesh Behri Saxena case in 2007.   Unfortunately majority of Sale Agreements are not being registered due to cumbersome procedure followed in the Offices of the Sub Registrars.  Simplifying the procedure will definitely result in increased revenue generation in the department.

2. Compulsory production of GST and CGST invoices while registration of apartments/flats. 

It is observed that many developers are registering apartments/flats without collection of GST and CGST from the buyers.  This has resulted in huge revenue loss to the Government.  By making production of GST and CGST invoices compulsory (as is being done  in Income Tax Department for production of 26Q TDS Certificate) revenue collection may be drastically increased.

3.   Latest Tax Paid Receipts:

Compulsory production of Latest Tax Paid Receipt for the property  while registration of  will help Local bodies in generating revenue collection particularly in recovering huge  arrears of property tax.

4. Periodical review of Guidance Value:

It is observed that due to unscientific procedure followed in  fixing of Guidance Value several commercial properties are being registered at a very lower price  than their actual transaction value. It also resulted in generation of black money.  In Chickpet, Jayanagar, HSR Layout commercial properties are being sold at the rate of more than Rs. 50000/- to Rs. 1,50,000 per square feet whereas they are being registered at a guidance value which is still fixed around Rs 15000/- per square feet. In Chickpet actual market value is more than Rs. One Lakh Fifty Thousand  per square feet but are registered at a very lower rate  and thereby causing revenue loss to the government. 

We therefore request you to resort to alternate methods of revenue collection instead of resorting to bring pressure on the Sub Registrar by fixing impossible targets.
