Parties to a suit are permitted to amend their pleadings at any stage of the proceedings for the purpose of determining the material question in dispute between them – the courts will be lenient in accepting this if this is done before the commencement of the trial .
If such application is made after the commencement of the trial, the Court will have to come to the conclusion that despite due diligence, the party could not have raised the case before the commencement of the trial.
