Execution for delivery of vacant possession of land -
Order 21, Rules 35(3) and 98 C.P.C. - Execution - Possession - Title - Ownership - Execution for delivery of vacant possession of land - J.D. raised construction and let out the same during the pendency of the litigation on the land in dispute - It is for the executing Court to decide every question regarding right , title and interest in the property in execution proceeding - Filing of separate suit is not necessary - Once the decree for possession has become final, tenants inducted during the pendency of suit, are not the necessary parties - Bailiff is entitled to remove the obstruction to execute the decree - If the real owner has an enforceable right and title in law, he cannot be deprived of enjoyment of his right of possession - No illegality in directing demolition of construction and delivery of possession to the decree holder - J.D. cannot be allowed to obstruct the execution of the decree and the process of law.
