Abuse of power
Krishna Iyer, J. in Bhut Nath Mete v. State of W.B., reported in (1974) 1 SCC 645, which was a case concerning preventive detention : “An administrative order which is based on reasons of fact which do not exist must therefore be held to be infected with an abuse of power.”
