"While imposing conditions in default bail, the court may impose such conditions only to ensure that the accused will appear before the court concerned for trial and will also cooperate with the investigation. The accused kept in custody under section 167(2) will be released on bail after the period of custody mentioned, if he is ready to furnish bail. This statutory right cannot be bypassed by imposing onerous conditions. Such arbitrary condition imposed while granting statutory bail violates Article 21 of the Constitution of India. There is a violation of the fundamental rights of the prisoner under this Act."
