No title in respect of immovable properties can be transferred on the basis of an unregistered sale agreement or on the basis of an unregistered general power of attorney.
“…No title in respect of immovable properties can be transferred on the basis of an unregistered sale agreement or on the basis of an unregistered general power of attorney. Even if these documents i.e. the agreement to sell and the power of attorney were registered, it cannot be said that the defendant would have acquired ownership over the property in question. At the most, on the basis of the registered sale agreement, he could claim the relief of specific performance in the appropriate proceedings. In this regard, reference may be made to Sections 17 and 49 of the Registration Act and Section 54 of the Transfer of Property Act, 1882.
