Section 482 CRPCÂ Sections 447, 427, 506, 148 and 149 IPC Second petition for quashing of FIR and order declaring proclaimed offender as 16 co-accused acquitted Sought for Firstly, present is second petition for quashing of FIR, first having dismissed on 6.3.2007 and filed through power of attorney without any exceptional circumstances having been disclosed other than fact that petitioner was of age of 73 years and a resident of Canada - Coaccused of petitioner acquitted in year 2014 whereas present petition for quashing of FIR filed in year 2021, 07 years after judgement of acquittal - Even otherwise, mere acquittal of co-accused would not be ground to quash instant proceedings and petitioner would have had to come back to face trial as undertaken by him but has chosen not to do so despite this Court willing to stay operation of order thereby enabling petitioner to join proceedings - Hence, no quashing of FIR and order declaring as proclaimed offender.
