'Detention beyond the date of release is a violation of Article 21': Supreme Court awarded compensation of Rs 7.5 lakh to the convict for keeping him in jail after the sentence period

 The Supreme Court has directed the state of Chhattisgarh to pay Rs 7.5 lakh as compensation to a rape convict who was kept in jail after serving his sentence.  A bench of Justices Ajay Rastogi and CT Ravikumar said in a judgment delivered in May 2022 "When a competent court, on conviction, sentences an accused and in appeal, the sentence was modified after confirmation of the conviction and  Where the appellate decision has become final, the convict can be detained only for such period as he can legally be detained by virtue of the said appellate decision."
