the inculpatory part of his statement under S. 313 cannot be made the sole basis of his conviction.

S.313 – Examination of accused under section 313 – Extent to Which may be used against accused, including inculpatory Statement. Held, though no conviction can be based on the statement of the accused and the prosecution has to prove the guilt of the accused by leading independent and cogent evidence, nonetheless when the accused makes inculpatory and exculpatory statements, the inculpatory part of the statement can be taken aid of to lend credence to the case of prosecution ---  However, if the prosecution - evidence does not inspire confidence to sustain the conviction of the accused, the inculpatory part of his statement under S. 313 cannot be made the sole basis of his conviction.
