2010. S. R. 0. No. 277/2010.—

In exercise of the powers conferred by subsection (1) of section 2 of the Kerala Public Services Act, 1968 (19 of 1968) read with section 3 thereof, the Government of Kerala hereby make the following rules further to amend the Kerala Government Servants' Conduct Rules, 1960, namely.- RULES I. Short title and commencement.—

(l) These rules may be called the Kerala Government Servants' Conduct (Amendment) Rules, 2010. (2) They shall come into force at once.

2. Amendment of the Rules—In the Kerala Government Servants' Conduct 'Rules, 1960, for rule 56, the following rule shall be substituted, namely:- — "56. Communication of official documents or Jnforrnation.—Every Government servant shall, in performance of his duties in good faith, communicate information to a person in accordance with the Right to InIormation Act, 2005, (22 of 2005) and the rules made thereunder:

mi Provided that no Government servant shall, except in accordance with zny general or special order of the Government or in performance in good faith of the duties assigned to him, communicate, directly or indirectly, any official document or any part thereof or classified information to any Government servant or an other person to whom he is not authorised to communicate such document or classified information".

Explonatory Note (This does not form part of the nofication, but is intended to indicate its general purport). Government of India amended rule 11 of the Central Civil Services (Conduct) Rules, 1964 in response to the requirements of the Right to Information Act, 2005. In its first report, the Second Administrative Reforms Commission has suggested that all States need to amend rules in a similar manner keeping with the letter and spirit of Right to Information Act. Accordingly, Government have decided to amend the Kerala Government Servants' Conduct Rules, 1960. This notification is intended to achieve the above object.
