Minerva Mills v.UOI : In this case the validity of clauses 4 and 5 of 42nd CAA and Article 368 inserted under 42nd CAA was challenged. The Supreme Court said that both these articles were attacking the basic features of the Constitution, hence both these articles were declared unconstitutional by the Supreme Court.
After this matter, it was finally decided that the Constitution is supreme. Neither the judiciary nor the Parliament and Parliament cannot exercise unlimited amending powers. Constitution is precious, you cannot destroy it.
The meaning of basic structure is not defined anywhere but this concept was given to prevent arbitrariness of state and executive when there is conflict between law and executive or legislature.
