Since the petitioner (revisionist) had to face a criminal trial which is not maintainable against him and was forced to remain confined in the correctional home for different periods of time, this Court is of the opinion that the petitioner deserves compensation as the petitioner had to suffer the agony and trauma of a criminal trial and also the detention by the learned Magistrate for taking cognizance against him and keeping him in custody for trial in a case which is not maintainable against him, a bench of Justice Bibek Chaudhary said.
